BY UPLOADING MATERIAL OR JOINING THE VIRTUAL EVENT I WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY!

I acknowledge that I am allowing my child to participate in a Pop-Up Play, LLC sponsored virtual event by my own free will and at my own personal risk. I will not allow my child to participate in a virtual event unless they are medically able and by my signature, I certify that my child is medically able to perform this event.

 

I agree to abide by Pop-Up Play team members relative to any aspect of my participation in this virtual event, including the right of any official to deny or suspend my participation for any reason whatsoever.  I attest that I have read terms in this waiver, the timeline of the virtual event, and agree to abide by them.  I assume all risks to me associated with participating in this virtual activity, including but not limited to: falls, bumping into furniture or other home environment obstacles and unpredictable interactions with other event participants.

Pop-Up Play, LLC is not responsible for illicit video or imagery that could compromise family privacy but will make the best efforts to ensure that other guests in the virtual activity are not affected by such a situation by turning off cameras and microphones. PopUpPlay is not responsible for a breach in privacy caused by, for example, a bathroom door being left open behind the camera. It is always the responsibility of the parents and the guests to be clothed and ensure that there is no inappropriate behavior displayed for the entire duration of the Virtual experience.

 

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH VIRTUAL ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

Having read this waiver and knowing these facts and in consideration of your accepting my registration, I, waive and release the Pop-Up Play, LLC and partners, all event sponsors, their representatives and successors from all claims or liabilities of any kind arising out of my child’s participation in this virtual event, and waive my ability to bring any legal action against the entities outlined in this waiver as I am voluntarily electing to allow my child to participate in this virtual event.  I grant permission to all of the foregoing to use my child’s photographs which I may share online as part of the event, personal data provided during registration and post-event reporting, video or audio recordings, or any other record of this event for any legitimate purpose. 

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT AND I AM AWARE THAT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST POP-UP PLAY, LLC AND ALL PARTNERS OR SPONSORS.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THE RULES GOVERNING MY PARTICIPATION AND/OR MY CHILD/WARD’S PARTICIPATION IN ANY ACTIVITY AT POP-UP PLAY, LLC.  

IF I DO NOT AGREE TO THE TERMS OF THIS AGREEMENT I UNDERSTAND THAT I MUST DISCONTINUE MY ACCESS TO THE SERVICES. ANY CONTINUED USE OF THE SERVICES SHALL BE CONSIDERED AS ACCEPTANCE AND CONSENT TO THE TERMS OF THIS AGREEMENT BY THE USER OR THEIR PARENT OR LEGAL GUARDIAN.
